When you are arrested on a state level charge, say you get pulled over, your license was suspended, and they take you to jail. You will get booked, processed, and placed in a cell until the magistrate arrives and you are able to go before a judge and get a bond. As long as you are not a flight risk then you are almost guaranteed a bond. A bond is Bail money, property, or a bond paid to the court in exchange for a defendant’s release from jail while awaiting trial. The purpose of bail is to ensure that defendants, once released, show up for future court dates. (“How Bail Works : Getting Out of Jail | AllLaw”)
If you are involved in a federal case, you will be indicted. Once they locate and arrest you, you are to remain in the custody of the courts until your trial. If you choose to fight and go to trial this means you will be spending at least 2-4 years in the county jail between hearings. Then they will throw an offer at you. They will tell you that if you plead guilty you will only receive, for example 15 years but if you go to trial and try to argue your case you will receive the maximum sentence depending on what charges they have and what the maximum sentence is for that offense. Example: Sign our plea for 15 years now or go to trial and be charged 25+. It is stated like that is your only option “or else”. This is intimidation, bullying, and undermining and it is NOT a FAIR RIGHT TO TRIAL!! This is what is happening RIGHT NOW within our courts and prison systems.
So again, the reason that they have such a high conviction rate is simply because the defendant
- Is fed up with being locked up in a local jail
- Is faced with either signing a plea deal now or fighting to lose their case unless they are completely innocent, even then they have a slim to none chance of winning.
- They are alone, kept unaware of what is going on outside of the jail, and they have no way to prepare for their trial.
- They mentally cannot handle the unknown of where their life stands. If they sign now, they know. It may not be a fair sentence, but at least their life is in their hands again and they can start working on the time they face. Being in jail and not knowing how long you’re going to be in there is an unimaginable terrifying/unable to breathe feeling.
This is how the federal government has such a high conviction rate. By taking away all your rights, your freedom, and lastly what little voice you do have left. Simply appalling. This must be addressed. Any ideas on how to overcome this completely unfair and one-sided sentencing maneuvering are welcome.
